By accessing or using Zest Exchange, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. Zest Exchange reserves the right to modify these terms at any time without advance notice. Continued use of the service after changes are posted constitutes your acceptance of the revised terms.

To use Zest Exchange, you represent and warrant that you:

• Are at least 18 years of age and have the legal capacity to enter into a binding contract
• Are transferring only funds that are legally yours and lawfully obtained
• Are not performing, undertaking, engaging in, aiding, or abetting any unlawful activity
• Will comply with all applicable local, national, and international laws and regulations

Zest Exchange reserves the right to terminate access to the service at any time and for any reason without prior explanation.

Permitted Fund Sources

You may not use Zest Exchange for transactions involving funds derived from criminal or fraudulent activity, terrorist financing, tax evasion, or any other unlawful source. You may only transfer funds on your own behalf — third-party transfers are prohibited. Zest Exchange and its partners reserve the right to refuse, postpone, or cancel any transaction suspected of violating these restrictions.

Prohibited Jurisdictions

Access to Zest Exchange is prohibited for residents or nationals of: Cuba, Iran, North Korea, Crimea, Sudan, Syria, USA (including its territories), Bangladesh, Bolivia, and any country subject to UN Security Council sanctions. This restriction applies regardless of the method used to access our services, including VPNs or proxies.

Prohibited Conduct

• Attacking, disrupting, or attempting to gain unauthorised access to our systems
• Using automated bots, scrapers, or crawlers without written permission
• Circumventing any security or rate-limiting measures
• Attempting to manipulate exchange rates or exploit system vulnerabilities

Cryptocurrency exchange rates are highly volatile. Zest Exchange and its partners are not responsible for financial losses resulting from rate fluctuations between the time you initiate and complete a transaction.

• For fixed-rate orders, rates are locked for 30 minutes. Orders not funded within this window may be cancelled or repriced at the prevailing market rate.
• You must send the exact amount specified. Underpayments or overpayments may cause delays or require manual resolution.
• Where required, you must include the correct extra identifier (Payment ID, Memo, Destination Tag, etc.). Deposits sent without required identifiers may be unrecoverable.
• Broadcasting a payment to the blockchain does not constitute acceptance by Zest Exchange of that payment. Acceptance occurs only upon confirmation in accordance with our processing requirements.

Rate Volatility

During periods of extreme market volatility (typically a swing of 3% or greater), exchanges may require extended processing time or, in exceptional circumstances, result in assets being returned. All transactions, once executed, are final and non-refundable unless otherwise set out below.

All transactions processed by Zest Exchange are irreversible and final. Refunds are considered only in the following circumstances:

• The transaction status shows Overdue and funds were received but not processed
• A request is submitted within the 90-day window from the original transaction date

Transactions with status Finishedare not eligible for refunds. Each refund request is reviewed on a case-by-case basis, and Zest Exchange's decision is final.

Additional Refund Rules

• Only one deposit per exchange ID is accepted. Multiple deposits require contacting support.
• Deposits of unsupported currencies cannot be refunded.
• Refunds are not provided for deposits below our minimum threshold. We discourage transactions of $30 or less.
• Deposits made without required extra identifiers (e.g. Memo, Destination Tag) are not eligible for refunds.
• Requests submitted more than 90 days after the transaction date will not be processed.

Zest Exchange is not liable for funds sent to phishing websites or fraudulent addresses that impersonate our service. To protect yourself:

• Always verify you are on the correct official domain before transacting
• Check your browser's security certificate to confirm the site's authenticity
• Never respond to unsolicited messages requesting personal information or funds
• Contact us directly through official channels to verify any unusual requests

If you suspect a phishing attempt, please report it to support@zest.exchange immediately.

Zest Exchange minimises data collection and requests only the information necessary for service operation and legal compliance. We retain data only for as long as required to support refund requests and resolve service issues. For full details, please review our Privacy Policy.

All content on this website — including graphics, text, logos, and informational materials — is the property of Zest Exchange or its licensors and is protected under applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any site content without prior written permission.

To the maximum extent permitted by applicable law, Zest Exchange and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service. This includes but is not limited to losses resulting from exchange rate fluctuations, transaction delays, third-party failures, or events outside our reasonable control.

These Terms of Use are governed by and construed in accordance with applicable law. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the relevant courts. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
